Privacy Policy
Last updated: October 14, 2026
This Privacy Policy explains how Maria ("Maria," "we," "us"), a product operated by Ausem Capital LLC ("Company"), collects, uses, and shares information when you use our website and application (the "Service"). By using the Service, you agree to the practices described here.
1. Who uses Maria
The Service has three kinds of users: brokers (commercial finance / MCA submission professionals who use Maria to match deals against a list of lenders), lenders (funding companies who list their own underwriting criteria on Maria's marketplace), and referral partners (people who introduce brokerages to Maria in exchange for a commission). This policy covers all three.
It also covers the limited information Maria holds about merchants — the businesses whose deals are submitted through the Service. Merchants are not users and do not have accounts, and Maria holds no personal contact details for them: a deal carries the business name and the financing criteria, not the owner's name, phone or email. Section 2 describes what is collected, and Section 4 who sees it.
2. Information we collect
- Account information. Name, email address, and authentication data, handled by our authentication provider, Clerk. If you sign in with Google, Clerk receives basic profile information (name, email) from Google under Google's own terms.
- Organization information. If you sign up as a broker, we collect your brokerage/organization name and the roles and email addresses of teammates you invite.
- Deal information. When you describe a deal to Maria (via the chat interface or the structured form) — credit score ranges, time in business, revenue, state, industry, and similar business-financing details — that information is processed to generate lender matches and is stored so you can revisit past match results.
- Lender listing information. If you sign up as a lender, we collect your company's underwriting criteria and contact details (submitted by you) for review and, once approved, inclusion in the shared lender list brokers search against.
- Merchant information. A lender who picks up a deal records the business name, and a broker may add it to their own copy or have their CRM supply it. That is the only thing Maria holds about the merchant. We deliberately do not collect the business owner's name, phone number, or email address: the broker and the lender already exchange those directly, and a second copy here would be exposure without a purpose. If your CRM sends them to us, they are discarded rather than stored.
- Funding outcomes. When a lender records a deal as funded, they enter the amount advanced, the factor rate, the term and collection frequency, and the broker's commission points. These are shown to that lender and to the broker who submitted the deal, and to nobody else.
- Logos. If you give us your website, we fetch the logo or icon that site publishes and store a copy. You can upload your own image instead, which we store and serve. Both are shown publicly alongside your listing or to the parties you work with.
- Referral partner information. If you apply to be a referral partner, we collect your name, phone number, and email address, and we record which brokerages signed up through your code and the commission accrued on their subscriptions.
- Billing information. Payment card details are collected and processed directly by our payment processor, Stripe. We do not receive or store your full card number.
- Usage data. Basic technical data (IP address, browser type, pages visited) collected automatically as part of operating the Service.
3. How we use your information
- To operate the matching engine and return ranked lender results.
- To process deal descriptions submitted through Maria's conversational chat, which is processed using Anthropic's Claude AI models to extract structured deal details from natural-language text you type in.
- To manage your account, organization, billing, and subscription status.
- To review and approve/reject lender marketplace submissions.
- To communicate with you about the Service (billing notices, product updates, support).
- To maintain the security and integrity of the Service.
4. Lender contact-sharing feature
When a broker submits a deal to a matched lender, Maria shares that broker organization's contact information (name, phone, and email, as entered in their account settings) with that lender, so the lender can respond. This happens only when both of the following are true: (a) the broker selected that lender on the results and pressed Submit, and (b) that lender maintains an active, paid listing on Maria's marketplace. Running a search shares nothing with anyone, however many lenders it matches: only the act of submitting does, and only with the lenders selected for that submission. Brokers who do not wish to be contacted can decline to submit, or leave their contact fields blank. Sharing is not retroactive — a deal already submitted cannot be un-shared from the lender who received it.
Sharing runs in the other direction as well, and is likewise conditional. A lender's own submissions contact details — contact name, phone, and email — are shown to brokers only while that lender maintains an active, paid listing on Maria's marketplace. Lenders who have no marketplace account, or whose subscription has lapsed, are still matched against deals on the strength of their published criteria, but their contact details are never displayed; brokers are told to contact those lenders through their own existing channels instead. Lenders control this by starting or stopping their listing.
5. Who we share information with
We share information with the following categories of service providers, each acting on our behalf:
- Clerk — authentication and user/organization management.
- Stripe — payment processing and subscription billing.
- Supabase — database hosting for the information described above.
- Anthropic — AI processing of deal descriptions submitted via Maria's chat.
- Vercel — application hosting and infrastructure.
- Resend — delivery of transactional email (deal notifications, account and billing messages).
Separately, if you connect your own CRM, Maria sends that system the deal information you have asked it to sync — including merchant details and deal stages — and accepts updates back from it. That destination is chosen by you, not by us, and once data reaches it, it is governed by your arrangement with that provider rather than by this policy. You can disconnect it at any time from your settings.
We do not sell your personal information. We do not share broker contact information with lenders except as described in Section 4 above.
6. Data retention
We retain account and deal-matching data for as long as your account remains active, and for a reasonable period afterward to comply with legal, tax, and accounting obligations. You may request deletion of your account and associated data by contacting us at the email below, subject to records we're required to retain by law.
7. Your choices
You can review and update your account information at any time from within the Service. Contact sharing has no separate switch because nothing is shared until you submit a deal: see Section 4. A lender can stop their details being shown by ending their listing; a broker can decline to submit, or leave their contact fields blank. To request a copy of your data, to ask that it be deleted, or to ask what we hold about a merchant, contact us using the information below.
8. Children's privacy
Maria is a business tool intended for commercial finance professionals and is not directed to, and should not be used by, anyone under 18 years old.
9. Changes to this policy
We may update this Privacy Policy from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify account holders directly.
